Freedom of Information Requests

The Freedom of Information Act 1982 (Cth) applies in respect of the Federal Court only to documents which relate to matters of an administrative nature (see section 5).

Access to court documents (which are exempt from the Freedom of Information Act) is provided having regard to sections 17 and 50 of the Federal Court of Australia Act 1976 (Cth) and Rule 2.32 of the Federal Court Rules 2011.

FOI procedures and initial contact points

Requests to the Federal Court for access to documents that relate to matters of an administrative nature must:

• be in writing;
• indicate it is made for the purposes of the Freedom of Information Act 1982;
• provide enough information concerning the documents sought as is reasonably necessary to enable the Court to identify them; and
• give details of how notices under the Freedom of Information Act 1982 can be sent to the applicant (for example an electronic address to which electronic communications might be sent).

There is no application fee.  Processing charges do not apply where a person is seeking access to a document that contains his or her own personal information but may otherwise apply under certain circumstances. Any such charges may be reduced or waived on grounds including hardship or the public interest.
