Publicly available information released following an FOI access request

The Federal Court is required by section 11C of the Freedom of Information Act 1982 (Cth) (FOI Act) to publish a disclosure log on its website. The disclosure log lists information which has been released in response to an FOI access request. This requirement has applied since 1 May 2011.

The disclosure log requirement does not apply to:

  • personal information about any person if publication of that information would be 'unreasonable'
  • information about the business, commercial, financial or professional affairs of any person if publication of that information would be 'unreasonable'
  • other information covered by a determination made by the Australian Information Commissioner if publication of that information would be 'unreasonable'
  • any information if it is not reasonably practicable to publish the information because of the extent of modifications that would need to be made to delete the information listed in the above dot points.

The information described in this disclosure log has been released by the Federal Court under the FOI Act and is available for public access.

A link is provided if the information can be downloaded from this website or another website.

Information that is not available on a website may be obtained by writing to the Court's FOI Contact Officer.

A charge may be imposed to reimburse the Federal Court for the cost incurred in copying or reproducing the information or sending it to you. There will be no charge for the time spent by the Federal Court in processing the FOI request that led to this information being made available. You will be notified if any charge is payable and required to pay the charge before the information is provided.

1 Access was provided to an edited copy of the email sent from the law firm to Registrar John Mathieson. The edited copy was redacted to exclude exempt personal information and irrelevant data.

Access was not provided to a confidential attachment to the email. The attachment was a letter. The letter contained business and/or professional information, disclosure of which was, on balance, contrary to the public interest.

It was not reasonably practicable to prepare an edited version of the letter.

2 Access was provided to an edited copy of the email sent from the law firm to Registrar John Mathieson. The edited copy was redacted to exclude exempt personal information and irrelevant data.

The email that was sent to Registrar John Mathieson from the law firm on 29 July 2015 had attached to it a copy of the letter referred to in (1) above. Access was not provided to that letter as it was confidential.

The letter contained business and/or professional information, disclosure of which was, on balance, contrary to the public interest.

It was not reasonably practicable to prepare an edited version of the letter.

3 Access was provided to an edited copy of the email sent from the law firm to Registrar John Mathieson. The edited copy was redacted to exclude exempt personal information and irrelevant data.

4 The email sent from Registrar John Mathieson to a partner, senior associate and graduate at a law firm had attached to it documents A, B, C, D, E and H (referred to in the column to the left) along with copies of a Department of Finance Resource Management Guide No. 409 and a Commonwealth Ombudsman Fact Sheet 9.

Access was granted in full to the aforementioned attached documents.
