Getting started

(eL & eC) What are the Federal Court’s on-line applications?

  • eLodgment – an web based service to electronically file documents in General Federal Law (FCA & FMC) proceedings
  • eCourtroom – a web based service  to conduct particular proceedings in General Federal Law (FCA & FMC) via a virtual courtroom

(eL & eC) What is the difference between eCourtroom and eLodgment

  • eCourtroom and eLodgment
    eCourtroom is a virtual courtroom where as eLodgment is an online document filing service.

(eL & eC) What is the difference between eCourtroom and eCase Administration

  • eCourtroom and eCase Administration
    Both are part of the eCourtroom application.  eCourtroom is host the public discussions as if they were being had in a physical courtroom,  where as eCase Administration is where private discussions are held, similar to those held in chambers.

(eL) What is eLodgment?
eLodgment makes it possible for litigants to electronically lodge documents with the Federal Court of Australia and the Federal Magistrates Court of Australia (General Law).

Without the need to attend a Registry to lodge documents, the process becomes more efficient and cost effective.

(eC) What is eCourtroom?
eCourtroom is a virtual courtroom that assists in the management of pre-trial matters, ex parte applications for substituted service in bankruptcy proceedings and applications for examination summonses by allowing directions and other orders to be made online, in general Federal Law matters.

eCourtroom is a secure internet based facility that enables parties to a matter to participate in on-line discussions.  It ameliorates the need to present at a physical courtroom at a prescribed time.

(eL) Who can use eLodgment?
Any person wanting to file documents in the Federal Court or the Federal Magistrates Court (General Law), whether they are practitioners, law firms, corporate bodies or self represented litigants can register to use eLodgment.

(eC) Who can use eCourtroom?
An eCourtroom is commenced only at the Judge or registrars discretion.  Then only parties to the matter can contribute to an eCourtroom.  Parties must register with eCourtroom in order to access the matters in eCourtroom.

(eL) How do I use eLodgment?
There are 5 easy to follow steps to eLodge documents via eLodgment. Once your registration has been accepted, all you have to do is…
  1. Select the Jurisdiction and Type of Action
  2. Upload the documents and any supporting documents
  3. Enter the contact details of the person responsible for the eLodgment
  4. Pay any necessary fees either via credit card, an account or ask the Court to reduce the fees (Lodgment of a fee waiver form required)
  5. Finalise and submit the eLodgment.

(eL) What are the benefits of eLodgment?  
eLodgment is a quick and efficient way to file documents with the Federal Court and the Federal Magistrates Court. There are a number of significant benefits and features:

  • Availability
    eLodgment allows registered users to lodge documents any time, on any day of the week. However, documents eLodged outside of the normal registry hours (check website) will be processed during normal business hours. Registries will process documents submitted up to 4:30pm as being submitted on that day. Any documents received after 4:30pm will be deemed to be filed the next business day.
  • Reduced costs
    Reduction of paper, photocopy, postage and courier costs.
  • Accessibility
    Lodging parties can view and save their electronically lodged document as soon as it is accepted for filing. This greatly speeds delivery and eliminates costs to both the court and parties.
  • Customisable templates
    For large volume users there are customisable user templates enabling users to save any standard data and re-use it as required for future eLodgments.

(eL & eC) Do I need to pay to use eLodgment or eCourtroom?
No - there are no fee for using eLodgment or eCourtroom. There are however fees attached to lodging particular document types which are payable by either credit card or account.

(eL) How do I establish a credit account facility?
To be provided with an account from the Court you need to meet certain conditions and submit an application form. More information and relevant forms are provided below or by emailing elodgment_admin@fedcourt.gov.au.

(eL) How long does it take to get an account?
You must first register with eLodgment before using it. The turn around time for processing eLodgment registrations is within 1 business day. 

If you have applied for credit facilities with the Court please allow 2 weeks for the processing of the application. In the meantime you may use Credit Cards (Visa, MasterCard and American Express ).

Please note:  Credit Card Payment of fees for FMC eLodgments can only be made with Visa or MasterCard.  AMEX cannot be used for FMC payments.

(eL) Can I lodge all documents through eLodgment?
You can lodge any initiating document and any supporting document. Similarly, documents can be lodged on existing matters via eLodgment as long as you know the file number.

Currently eLodgment cannot accept Draft or Consent orders, Certificate of Taxation or correspondence.  In eCourtroom you may attach these documents to a discussion however this is only for discussion purposes, the documents are not deemed to have been filed.

(eL & eC) Can I view the documents that I have eLodged?
Yes. As documents remain accessible via eLodgment, you can monitor the progress of your eLodgments as well as review the processed documents through your ‘Lodgment History’. You can access the sealed electronic versions of the documents if you want to email or print out for service.

If you have eLodged the document(s) from within an eCourtroom discussion, once they have been accepted for filing by the Court you will be able to access the document(s) from within the eCourtroom discussion.

(eL) How do I get my copies of sealed documents?
Once the documents have been processed you will receive an email containing a link to the processed documents.  Once in eLodgment, under Lodgment History you can access and download your processed documents through eLodgment.

If you have eLodged the document(s) from within an eCourtroom discussion, once they have been accepted for filing by the Court you will be able to access the document(s) from within the eCourtroom discussion.

(eL) How long does it take for my documents to be processed?
During registry business hours your eLodged document(s) will generally be processed within an 1 hour after being received by the registry. Once processed, they will be available via the Lodgment History area of eLodgment.

Some documents may require more time to process.

Please Note: Processing of documents does not necessarily mean accepting the documents.

Accessing the system

(eC & eL) What computer equipment do I need to use eLodgment and/or eCourtroom?
A computer with an internet connection and a web browser;
an individual email account for contact purposes;

(eC & eL) How do I register for eLodgment and/or eCourtroom?
To register you need to complete the on-line registration which is available on the Welcome screen.

Once you click on submit, your registration request will be sent to the Court which, under normal circumstances, will process your request within 1 business day. You will receive an email notifying you of your registration approval, upon receipt of which you can log in and use eLodgment or eCourtroom.

Only one registration is required which can be used for both eLodgment and eCourtroom.

(eC & eL) How do solicitors obtain access to the Federal Court on-line applications?
All users need to register to use eLodgment or eCourtroom (see above). Processing of new registrations may take up to 1 business day.

(eC & eL) How do I receive my username and/or password?
During the registration process you will be prompted to create a Username and a Password. Once you receive an email from the Court saying that your registration has been approved. 

(eC & eL) What information will I need to enter when I register?
To register with eLodgment:

  • If you are a law firm/company/business you need:
    • ABN/CAN
    • Registered address
    • Postal address
    • Contact details (including individual name and email address)
  • If you are registering as a Self Represented Litigant (SRL)
    • Name
    • Postal address
    • Contact details (including individual email address)

It is also a good idea to think of your Username and Password and a Secret Question and answer in advance.

(eC & eL) What is meant by Secret Question?
This is a secret question that only you know the answer to. You must enter the question and the answer. If you forget your username or password the system will use the question for verification before emailing you the information.

(eC & eL) When I enter the suburb/postcode it will not accept it !
When entering the suburb, type really slowly and it will prompt you with options which you can select. The "/" in the field name is misleading as you don't need that. It will also automatically fill out the state.

(eC & eL) I forgot my password. What do I do?
eLodgment and eCourtroom will allow you 3 attempts to enter your Username and Password.  If on the 3rd successive attempt an incorrect username or password is entered the applications will lock the username for a period of 30 minutes.  This will mean that you cannot access either eLodgment or eCourtroom for 30 minutes from the last failed attempt to log on.  As the user name is locked the forgotten password will not issue a new password, within this period.

(eC & eL) How do I reset my Password?
Click on the Forgotten Password link on the Log in screen. You will be prompted to enter your Username and to answer your Secret Question. eLodgment / eCourtroom  will then send a new password to the email address you used during registration. Once you receive the email, click on the embedded link and use the password provided. You can then change your password under the My Details tab once you have logged into eLodgment.

(eC & eL) How do I register my organisation?
eLodgment and eCourtroom work with individual registrations which are attached to an organisation as part of the registration process. Organisational data provided during the registration process enables the Court to link your username with your organisation.

(eC & eL) I have a username but I forgot my password. What do I do?
Click on the Forgotten Username or Forgotten Password links on the log in screen, answer the Secret Question correctly and the system will email you the information.

(eC & eL) How do I change my password after my username has been created?
Once you have logged into eLodgment or eCourtroom  you can change your password under the My Details tab.

(eC & eL) What do I do if I have forgotten the answer to my secret question?
Your secret question is your security key. 
It cannot be re-set for you and the Court cannot un-lock your access.  Please contact the Court (etc) to discuss the options you have available in this situation.

(eC & eL) How do I change My Details?
Once you have logged into eLodgment or eCourtroom you can change your details under the My Details tab. Remember if you change any of your details (for example your contact details) the relevant form needs to be lodged for the Court record to change.

Please Note: Changes within the user details of the  applications do not constitute a change in the record of the court.  You will need to file the appropriate documents to do so.

(eC & eL) I have changed Organisation / Law Firm can I still use eLodgment / eCourtroom?
NO – you will need to register with the new details.

You will also need to notify the Court if you are a party to any matter in eCourtroom.

(eC & eL) Can I have a generic username and password for my company?
eCourtroom users require a unique username and email address per user and this cannot be shared.

Due to security concerns it is best that individuals register with eLodgment as access is granted to a single individual. Sharing of usernames and passwords is not recommended.

(eC & eL) How secure is the information that I input?
It is your responsibility to keep your username and password secure to ensure that nobody else can access any information associated with your username and password. The eLodgment and eCourtroom application keeps your information secure through a Secure Sockets Layer (SSL) certificate to prevent unauthorised viewing and the application is hosted in a secure zone (DMZ).

(eC & eL) Who else can view my information?
In eLodgment the only people who can view any activity carried out under your username are yourself and selected officers within the Court who process the documents. 

The Public Transcript feature in eCourtroom enables members of the public to view the discussion postings in an eCourtroom, similar to attending Court in a physical Courtroom.  They cannot view the documents attached to postings nor can they view postings in eCase Administration.

It is best practice not to share your password with anybody and to change it regularly.

(eC & eL) How do I view documents that I have eLodged?
Once you have logged into eLodgment you can view all the documents you have eLodged under you username in the Lodgment History area of eLodgment.

If you have eLodged the document(s) from within an eCourtroom discussion, once accepted by the Court all participants in that particular matter will be able to view the documents via the eCourtroom.

(eC & eL) Can I eLodge documents on an existing matter?
Yes you can – as long as you have the File Number for that matter or are access an existing active eCourtroom.

(eC & eL) I have forgotten the file number for my matter. How do I find it?
If you click on the link to Federal Law Search, available under the eCourt Menu on the Federal Court’s website  you can search for a party or matter name which will produce the file number for you.

(eC & eL) How will I know if my eLodgment has been successful?
The final step of the eLodgment process will present you with a summary screen of all the information that you have entered and a Lodgment Number confirming that the document(s) have been successfully uploaded and have been queued for processing by the Court.

When an officer of the Court has processed the document(s) you will receive an email notification with an embedded link to the processed document(s).

If you have eLodged the document(s) from within an eCourtroom discussion, once accepted by the Court the link to the document(s) will become active.

(eC & eL) How do we notify the Court to update User Registrations when a Law Firm has changed its name?
If a Law Firm changes its name you should notify the Court by email eLodgment_admin@fedcourt.gov.au providing full details of any current user registration details under the old Firm Name.  Also provide the appropriate notice with details of the new firm name, address, email and contact details.
 
Additionally, parties must still notify the Court in writing that the firm has changed its name and file the appropriate documents on each of their current files so the Court records can be updated.

(eC) I’d like to contribute to a particular matter being run through eCourtroom how do I get access?
If you are not currently a party to the matter you must seek leave from the Court to participate.  You will also need to register to use eCourtroom if you have not done so already.

Payment options

(eC & eL) Do I need to pay to use eLodgment / eCourtroom?
NO - there are no fees for using the applications. There, are however, fees attached to particular document types filed via eLodgment which are payable by either credit card or account.

(eL) How do I pay filing fees for documents lodged via eLodgment?
You can pay the associated document fees by either credit card or account. If you cannot afford this fee you may be eligible to apply to the Court to have the fee reduced.   

(eL) Do I need to set up a credit account to use eLodgment?
No – you can pay any associated fees by credit card.

(eL) How do I set up credit account facilities with the Court?
You need to apply to the Court’s Finance Section to set up Credit facilities. Click here for more information and an application form.

(eL) Will our pre-existing account facility be automatically transferred to eLodgment?
Yes, if you have a pre-existing account it will be transferred. The account information will be attached to the username during the processing of the registrations.

(eL) How do I ask the Court to reduce fees and in what circumstances can fees be reduced?
You needed to file a completed application for reduction of payment of court fees, along with supporting documentation at the f Registry, where a Registrar or an authorised officer will review your application.  You will be notified of the outcome of the review.

There are several circumstances where a person is entitled to a reduction in fees.  As these change from time to time it is best to check the federal Courts or Federal Magistrates websites for an up-to-date list of circumstances. 

(eL) If my documents are rejected and I've paid the associated filing fees how do I get a refund?

If you have paid by Account the amount will not be credited to your account unless the documents are accepted.

If you have paid the fees by Credit Card (MasterCard and Visa) the amount will be refunded directly to the card used for the payment. If you have used AMEX the amount will be refunded into a nominated Bank Account.

Refunding of Fees may take a couple of Couple of days to process before they appear on your statement.

(eL) I'm lodging documents from overseas what currency will I be charged in?

All fee transactions within eLodgment are in Australian Dollars (AUD$).

Rules and procedures

(eL) What are the rules and procedures regarding filing electronically?
Division 2.3 of the Federal Court Rules 2011 provide for the filing and lodging of documents by electronic communication.

Pursuant to Rules 2.07A and 2.07B Federal Magistrates Court Rules 2001 registered users are now able to file Federal Magistrates Court applications and supporting documents electronically.

(eC & eL) How are electronic documents served?
The Court does not serve documents – that is the responsibility of the parties. Under Rule 10.31 of the Federal Court Rules 2011 electronic documents may be served by email.

(eC & eL) How do I get my matter heard through eCourtroom?
Practice Note CM20 refers to the use of eCourtroom for ex parte applications for substituted service in bankruptcy proceedings and applications for examination summonses.  It is at the discretion of the Court to deem matters suitable for eCourtroom.  If you wish to have a particular matter heard through eCourtroom please contact the managing Registry.

(eC & eL) One of my documents is very large – how do I lodge it?

Division 2.2 of the Federal Magistrates Court Rules apply to the filing of documents including electronic filing and Rule 2.05 (1A) provides that a document may not be filed electronically if it is over 100 pages long.

Please contact your local Federal Court Registry or email eLodgment_admin@fedcourt.gov.au to discuss lodgment options for very large documents.

(eC & eL) When will documents eLodged via an eCourtroom discussion be available for viewing in the eCourtroom?
The normal processing time for eLodgment extends to those documents eLodged via eCourtroom.  While best efforts are made to process documents within 30 minutes this time is dependent upon several factors including that the eLodgment is all correct, the time of day the documents are eLodged and the number of eLodgments in the queue. 

(eC & eL) What is the required time to reply to an eCourtroom postings?
There is no prescribed turn-a-round time on responding to postings.  eCourtroom is meant to facilitate a flexible, yet structured, approach to the management of matters.  Normally the Judicial Officer will outline their intentions and requirements in the initial posting and/or through out the discussion. 

(eC) How do we obtain orders in an eCourtroom matter?
Delivery of orders is dependent upon what the Judicial Officer deems appropriate.  Sometimes orders can be attached to posts, other times they are made available via the CCP. A separate logon is still required for the CCP.

(eC) Can my paralegal / assistant contribute to an eCourtroom on my behalf?
Only those practitioners who have carriage of the matter are included as participants in an eCourtroom.  Any activity conducted using a particular username is the responsibility of that user.

(eC) How do I get my secretary added to a matter?
Only those practitioners who have carriage of the matter are included as participants in an eCourtroom.  Any activity conducted using a particular username is the responsibility of that user.

(eC) What’s the difference between attaching a document and filing a document via eLodgment when in a discussion in eCourtroom?
If you need to place a document on the Court official file you need to file the document via eLodgment.  IF the document is only a draft or correspondence and not to got on the official file you can simply attach it to the discussion.

(eC) I’m going on leave how do I get somebody else to contribute/monitor my eCourtrooms?
If you are unable to attend to your eCourtroom you need to make the same arrangements you make if you are unable to attend a physical courtroom.

Technical issues

(eC & eL) Do I need any special software on my computer to use eLodgment or eCourtroom?
No – all you need is access to the internet and a browsing application.  The Court’s on-line applications work best with Internet Explorer version 8 or 9 with Compatibility view turned on.  Other browsers may experience issues.

(eC & eL) What types of documents/files can I upload in eLodgment or attach to a discussion in eCourtroom?

You can up load the following types of files:
.DOC & .DOCX – MS Word Documents
.PDF - Portable Document Format
.XLS & .XLSX – MS Excel Spreadsheets
.JPG – Image Files
.RTF - Rich Text Format
.GIF - Graphics Interchange Format
.TIF – Tagged Image Format

Upon being accepted by the Court, documents will be converted to PDF files from their original file formats so that the Court seal and listing details can be added.

(eC & eL) Do we have to use PDF?
No – any of the file types mentioned above are acceptable. Upon being accepted by the Court, documents will be converted to PDF files from their original file format so that the Court seal and listing details can be added.

When submitting PDF files the Court’s preference is for searchable PDFs.  This maintains the text in the document enabling fast searches for key terms. 

You can check if your PDF is text searchable by running a quick test.  Search for a word that you know exists within the body of the text.  If you reach the end of the document without the word being found, your document is not text searchable but an image.

Some PDF applications enable you to convert an Image PDF to a Text searchable PDF by running OCR Text Recognition over the document.  Please consult with your IT department to check if your PDF application has this capability.

(eC & eL) Do I need to scan documents at the highest resolutions?
No, it doesn’t have to be at the highest resolution as long as it clearOriginals need to be kept in case you are requested to present them later.

Please Note: When scanning documents such as signed affidavits the size of the file created, regardless of the number of pages is dependent upon the resolution of the scanning.  In general, the higher the resolution the bigger the file size. The bigger the file size the slower the upload will be.

To minimise any potential upload issues it is best to keep the resolution as low as possible without compromising the clarity of the document.

(eC & eL) What is PDF?
PDF stands for Portable Document Format. It is a universal file format that preserves the fonts, images, graphics, and layout of any source document regardless of the application and platform used to create it.

(eC & eL) I want to load a PDF but it is not allowing me to?
PDF version 1.2 or less is not accepted.   Some PDF files of version 1.2 may not be accepted depending upon how the PDF file is created.

Some scanners save PDF documents as older versions of PDF, so if you have created the PDF by scanning it, check in the Document Properties of the file that it is an accepted version of PDF.

(eC & eL) How big can the documents be?
There is no restriction on the number of pages or the file size for documents filed in the Federal Court that are filed via eLodgment or attached to a discussion in eCourtroom.

However, due to technical limitations of the current applications no file larger than 10MBs can be uploaded.  This is to prevent performance issues caused by very large files being uploaded simultaneously.

To see how big a particular file or document is please refer to the Document Properties usually available under the File Menu when you have the document open, prior to attempting to upload the document / file.

(eC & eL) My file is too big, what do I do?
Try converting it to a PDF as they are usually smaller than other file formats. If that doesn't work, please contact your local Federal Court Registry or email eLodgment_admin@fedcourt.gov.au.  

DO NOT email the file as documents cannot be accepted for filing via email.

(eL) I made a mistake in my eLodgment. What do I do?
If you are still entering the data you can either use the edit button on any of the steps' summary screens prior to moving onto the next step, or use Amend Lodgment on the final summary screen just before you Finalise Lodgment.

If the eLodgment has been submitted please contact the Registry.

(eL) I am in eLodgment but I cannot see the Lodgment I want to see.
Are you looking in the correct area – there are 5:
- Incomplete
- Unprocessed
- Approved
- Pending
- Rejected

(eC) I’m in eCourtroom but why can’t see any posts
There are a couple of reasons why:

  1. The discussion has not been commenced yet.  A Judicial Officer has to commence a discussion – an external user cannot
  2. You are in eCase Administration and the matter is in eCourtroom or visa versa. Click on the tabs on the top of the screen to navigate through the different areas or eCourtroom

(eL) I didn’t get an email with the processed documents - what is going on?
You no longer receive an email attaching your processed documents - that was eFiling. You will only get an email when the eLodgment has been processed notifying you as such.  The email will contain a link to the processed document in eLodgment. You will not be emailed the sealed version of the documents.

(eC & eL) Every time I try to log in it says I am already logged in?
If you have crashed out or closed the browser unintentionally eLodgment thinks you’re still logged in. You can click on Proceed and that will terminate the ‘old’ session so you can continue to log in.

(eC & eL) Which browsers work with eLodgment/eCourtroom?
eLodgment and eCourtroom will work with;
- Mozilla
- Safari
- Firefox
- Internet Explorer

The Courts on-line applications work best with Internet Explorer version 8 or 9 with Compatibility view turned on.  Other browsers may experience issues.

While eLodgment will work with the above browsers some version of the browsers may experience issues displaying some components of the eLodgment screens, e.g.  If you are using IE 8 or 9 please ensure you turn on 'Compatibility View' prior to commencing an eLodgment.

Currently users of Google Chrome, and recent releases of Firefox, may experience issues in the screen display, upload of documents and or posts and time out issues when using eLodgment or eCourtroom.

Currently the applications are recommended for use on a mobile device.

(eC & eL) Who receives the automatic email notifications?
The registered users who is

  1. attached to an eCourtroom or
  2. who eLodged the document(s)

For this reason you must avoid using generic email addresses.

(eC & eL) Can we use a generic email address so that the team gets the notifications?
No – for security reasons all registrations must contain an individual’s email address. Email address such as teamA@lawfirm.com.au will not be accepted.

(eC) Why does eCourtroom require a personal email address?
The email address needs to be that of the person who has carriage of the matter in the lawfirm so that they can be notified of new activity within the eCourtroom.

(eC & eL) My computer crashed! What can I do?
eLodgment will keep any incomplete elodgments in the incomplete area. Simply log back into eLodgment and continue eLodging. If the application says you are already logged into another session, click on Proceed to close that session and to continue with the new one.

For security reasons eCourtroom will terminate your session requiring you to repost your contribution.

(eC & eL) I can't log in. What's wrong?
Have you received confirmation of your registration being accepted?
Have you got the correct username and password? – remember they are case sensitive.
Has your account been made inactive?
Do you have another session open?

If you have answered the above questions and still can not login please contact your local registry.

(eC & eL) I am trying to eLodge or attach a document but I keep getting an error message.
Please check the FAQs to ensure you are using a suitable browser and the file(s) is not too large. If you continue to experience difficulties please record the error message and contact your local Federal Court Registry or email eLodgment_admin@fedcourt.gov.au.

(eC & eL) Can I use eLodgment when in eCourtroom?
Yes – you may use eLodgment to file documents attached to a discussion or you can simply navigate between the two applications by clicking on the link under the Logout button.  Only documents eLodged from an eCourtroom discussion will be available for viewing in eCourtroom. Those eLodged directly through eLodgment will not be viewable.

Documents attached to a discussion in eCourtroom are not deemed as 'filed'.

(eC & eL) What is the maximum number of documents that I can attach to an eCourtroom discussion?
There is no limit to the number of documents you can attach to a discussion.

(eL) How secure is eLodgment?

The Court uses SSL V3 certificates by VeriSign, to encrypt information being transmitted through the Internet to the Court's eServices facilities. This encryption prevents the information being viewed or tampered with during transit.

Information entered into eLodgment (such as party names and details) is stored on a secure system that has been designed to ensure that loss, misuse, unauthorised access or disclosure, alteration or destruction of this information does not occur.

(eC & eL) Can I eLodge through the Commonwealth Courts Portal (CCP)
Not yet. Currently eLodgment is a separate application which can be access via the CCP by clicking on the hyperlink.
 
(eC & eL) Can I use my CCP ID to access eLodgment or eCourtroom?
Not yet. Currently eLodgment eCourtroom is separate from the CCP.  You will need to setup a separate account to for eLodgment/eCourtroom application.

(eC & eL) Is eLodgment part of eCourtroom?
Currently the applications are separate but connected.  If you are in eLodgment there is a link under the logout button to eCourtroom and similar link to eLodgment when you are in eCourtroom.  Even though both applications have their own login screen you can use the same user name and password in both. 

You can eLodge documents while in a eCourtroom discussion by clicking on the ‘File a document via eLodgment’ button this will open an eLodgment session containing all the relevant information on the matter. 

Documents attached to a discussion in eCourtroom are not deemed as 'filed'.
