Use: This
form should be used if you wish to discontinue
(that is, not proceed with) the whole or
part of your application or appeal to the
Federal Court ('the Court').
Filing fee: There
is no filing fee payable for lodging a
Notice of Discontinuance. If you discontinue
the whole or any part of your application
without the leave of the Court, you are
liable to pay the costs that the other
parties to the proceedings incurred before
the discontinuance. The amount of those
costs can be agreed between the parties
or determined by the Court. If the Court
gives you leave to discontinue then it
may also order you to pay all or part of
the costs of the other parties.
