Corporations Matters – Revised Administrative Arrangements (NSW 2004/1)

Note: This Practice Notice was superseded on 6 February 2006 by Practice Notice NSW 2006/1

1. This notice advises of the revised administrative arrangements for the handling of Corporations matters (being matters under the Corporations Act 2001 and the Australian Securities and Investment Commission Act 2001) in the New South Wales Registry of the Court from 1 April 2004. This Notice replaces the previous Corporations Notice to Litigants and Practitioners numbered NSW 2002/2.

Corporations List Judges

2. In the NSW Registry until further notice there are three Corporations List Judges:

Emmett J

Hely J

Gyles J

Listing of Corporations Matters

3. Urgent Corporations applications may be made any day of the week directly to the Corporations List Judge during business hours by contacting the associate to the Corporations List Judge on duty. The details of the duty Corporations List Judge are available daily in the Court List or on Level 3 of the Law Courts Building. For urgent Corporation matters out of business hours, the standard after hours arrangements for the Federal Court apply with parties being able to contact Law Courts Security desk on (02) 9230 8025.

4. Apart from urgent matters general Corporations matters are, on filing in the registry, initially made returnable before a Registrar on a Friday at 9.15 am.

5. The Corporations List Judge will sit on Fridays at 9.30 am to deal with matters appropriate to be dealt with by the Corporations List Judge including such matters forwarded from the Registrar’s list. In appropriate ex parte matters parties may wish to contact the associate to the duty Corporations List Judge to arrange for a suitable time for an ex parte hearing.

6. The Registrar deals with matters within the Registrar’s delegation and which the Registrar considers appropriate to be dealt with by the Registrar.

7. Matters that are not within the Registrar’s delegation and not forwarded to the Corporations List Judge will be allocated to a Corporations Panel Judge’s docket in the usual way.

8. The Corporations Panel consists of the following Judges:

Conti J, Emmett J, Gyles J, Hely J, Jacobson J, Lindgren J, Sackville J, Stone J, Tamberlin J.
