Practitioners are advised that until further notice the following practices will be adopted by the Federal Court of Australia in Corporations Law Matters.
Nomination of Official Liquidators where a winding up order is sought
Under Order 71 sub rules 20(5), 36(6) and 37(6) of the Federal Court Rules, the Registrar will nominate in rotation, official liquidators from the list provided by the Australian Securities Commission. In the event that the applicant for a winding up order believes the circumstances require the appointment of a particular liquidator, an affidavit should be filed with the application for nomination of a liquidator (Form 88). This affidavit should indicate the reasons why the particular liquidator is most appropriate for nomination. The Registrar will then take this affidavit into account when nominating an official liquidator.
Remuneration of liquidators
In fixing the remuneration of Provisional and Official Liquidators, the Federal Court will adopt the same scales as that used by the Supreme Court in each particular State or Territory.
