Bankruptcy Practice Sydney - Advice of adjournments to party or solicitor

When a Registrar makes an order for adjournment in the absence of a party or a party's solicitor, the Registrar will also make the "usual order in respect of notification."

This order means that:

1. (a) Where the party is unrepresented:

By close of business the day after the day on which the order is made, the party or solicitor appearing in court will send a letter to the absent party by pre-paid ordinary mail to his/her last known address. This letter must inform the absent party of the order made and of the details* of the adjourned date, time and place (including address) of the hearing;
(b) Where the party is represented by a solicitor
By close of business the day after the day on which the order is made, the party or solicitor appearing in court will send a letter to the absent solicitor by pre paid ordinary mail, to the solicitor's DX box or by facsimile. This letter must inform the absent solicitor of the order and the details* of the adjourned date, time and place (including address) of the hearing.

2. Affidavit of Service

An Affidavit of Service of the letter of notification must be filed either in the Registry or in Court by leave on the day of the hearing.
