Corporations matters and ASIC matters
NB: This Notice to Practitioners is superseded
The Federal Court (Corporations) Rules 2000 apply to proceedings in the Court under the Corporations Act 2001, the ASIC Act 2001 and associated legislation. The other Rules of the Court apply, so far as theya re relevant and not inconsistent with the Federal Court (Corporations) Rules 2000.
Powers of the Court specified in columns 2 and 3 of the items of part 1 of schedule 2 and also specified in column 2 of the items of part 2 of schedule 2 to the Federal Court (Corporations) Rules 2000 have been delegated to Registrars.
Matters commenced under the Corporations Act 2001 or the ASIC Act 2001 will be allocated to a judge's docket at the time of filing in the same way that other matters are currently allocated. Listing arrangements for Corporations Act 2001 and ASIC Act 2001 matters will be the same as for other matters.
Matters commenced under the Corporations Act 2001 and the ASIC Act 2001 that may be heard by a Registrar pursuant to the delegation referred to above will be listed before a Registrar at 10.15 am on Wednesday of each week. Matters initially listed before a Registrar but which need to or are appropriate to be referred to a judge for hearing will be allocated to a judge's docket in the same way as other matters. Such matters will be listed for hearing in accordance with the directions of the docket judge and those listing arrangements will be communicated to the parties by the registry.
